Business reorganisation transfers in cooperative bank reorganisations are treated as non recognised transfers, aligning shareholder swap rules accordingly.

The amendment inserts two clauses treating transfers in cooperative bank reorganisations as non recognised: transfers of capital assets by a predecessor cooperative bank to a successor cooperative bank made in a business reorganisation, and transfers by a shareholder of shares in the predecessor cooperative bank in consideration for shares in the successor cooperative bank. The terms business reorganisation, predecessor cooperative bank and successor cooperative bank adopt the meanings assigned in the referenced reorganisation provision.
