Employer remedy orders under workplace safety law can suspend liability during compliance period, then trigger daily fines.
On conviction of an employer of a mine, factory or dock for an offence under the Code, the court may order, in writing, that the employer within a specified period (extendable on application) take specified remedial measures to remedy the matters constituting the offence. Compliance within the period or any extension suspends liability for continuation of the offence during that time; failure to comply by expiry results in the employer being deemed to have committed a further offence, punishable by up to six months imprisonment, or a daily fine up to one hundred rupees, or both.
