Retrenchment must ordinarily follow last in first out within worker categories, unless documented reasons justify otherwise.

Where an Indian worker in an industrial establishment is to be retrenched and belongs to a specific category, the employer shall ordinarily retrench the worker who was the last person employed in that category in the absence of any agreement; the employer may retrench another worker only for reasons to be recorded.
