Persons arrested or detained without warrant or brought before a Court who are not accused of a non-bailable offence and who are prepared to give bail must be released on bail; if indigent and unable to furnish surety, the officer or Court may or shall discharge the person on his executing a bond for appearance, with inability to give bail within a week creating a presumption of indigence.
