Framing of charge: procedure for transferring or framing and securing accused's plea in session trials
Section 251 governs framing of charge: if the offence is not exclusively triable by the Court of Session, the Judge may frame a charge and transfer the case to a Chief Judicial Magistrate or first-class Judicial Magistrate to be tried as a warrant-case on police report; if the offence is exclusively triable by the Court of Session, the Judge must frame a written charge within the prescribed pre-trial period.
