Absence of complainant allows discharge of accused if offence is compoundable or non cognizable before charge is framed.

Where proceedings were instituted on complaint and on a hearing day the complainant is absent and the offence is compoundable or non-cognizable, the Magistrate after giving the complainant thirty days to be present may, in his discretion and at any time before the charge has been framed, discharge the accused.
