Declaration of forfeiture review - may be set aside where the material lacked the proscribed content.

An application may be made to set aside a declaration of forfeiture for a newspaper, book or other document if the issue did not contain the proscribed matter, within the period after publication in the Official Gazette. The High Court may admit newspaper copies as evidence of the nature or tendency of the contents. Matters are to be heard by a Special Bench, and if the court is not satisfied the issue contained the proscribed matter it shall set aside the declaration; majority view prevails on differences.
