Failure of public servant to apprehend or detain offenders is a criminal offence carrying tiered imprisonment based on offence severity.

Intentional omission by a public servant to apprehend or to keep in confinement, or intentionally suffering or aiding a person's escape from custody, is an offence. Penalties are tiered by the severity of the offence charged against the person: up to seven years' imprisonment where the offence is punishable with death; up to three years where punishable with life imprisonment or up to ten years; and up to two years where punishable with imprisonment for a term less than ten years, each with or without fine.
