Adjudicating Authority proceedings remained valid despite vacancies, appointment defects, or procedural irregularities not affecting merits.

Section 16 of the Prohibition of Benami Property Transactions Act was inserted in 2016 and later omitted in 2021. Earlier, it stated that no act or proceeding of the Adjudicating Authority would be invalid merely because of a vacancy or defect in the Authority, a defect in the appointment of a Member, or a procedural irregularity not affecting the merits of the case.
