Applications against delinquent company directors, promoters and officers must be by summons served seven days before hearing.

Applications under section 339(1) or section 340(1) must be made by a summons returnable in chambers stating the nature of the declaration or order sought and the grounds, served on every person against whom an order is sought not less than seven days before the hearing; no affidavit or report need be filed before return and the summons shall be in Form WIN 72 or Form WIN 73 with necessary variations.
