Cognizable and non-bailable offences under the Act carry a restricted bail regime: release is barred unless the Public Prosecutor is heard and, if opposed, the court is satisfied there are reasonable grounds to believe the accused is not guilty and not likely to reoffend. Special Court may grant bail for young persons, women, the sick or infirm, or accused of laundering sums below the specified threshold. Cognizance under section 4 requires a written complaint by the Director or an authorised Central Government officer, and police may investigate only with Central Government authorization.
